This AI Services Statement (the “Statement“) outlines the use of artificial intelligence (AI) across the Employment Hero Platform, including the Swag app, Employment Hero websites, and any additional products and services (EH Platform).
This Statement provides transparency on our AI Services, how they operate, the data handling practices involved, and the technology partners who support the delivery of the AI Services.
Our AI Services are embedded as core features or services of the EH Platform, and you may not be able to opt out of its inclusion. There are some AI Services that you can simply not use if you do not agree to its inclusion in the EH Platform.

Inclusion of the AI Services
The EH Platform incorporates AI Services that you may voluntarily use, which are designed to offer you the best experience possible when using the EH Platform. There are some AI Services that are core inclusions in our provision of the EH Platform, like AI-Powered Implementations for business customers, which is necessary for effectively onboarding you as a customer and giving you a seamless experience.

An AI-powered chat tool that answers questions your employees may input relating to their business and employment, based on the organisation account information. Hero AI can also provide you with answers to your questions by utilising the information in your company policies and the ‘knowledge based articles’ on our help centre. The data that is processed through this service is the data you input by voluntarily using it, and the data it needs to process within your organisation account or from external sources, to provide relevant outputs. |

Intelligent content editing and rewriting feature that operates only on your command. The data that is processed through this service is only the data you actively input if you voluntarily decide to use it. |

Our customers start their journey using the EH Platform through our Implementations services. These services are powered by AI to ensure efficient and effective onboarding of new customers. To carry out the implementation of the EH Platform, customers need to provide us with business and employee details, including personal data of employees (like name, DOB, address, payroll data and other employment information). This information is crucial for the setup and configuration of the EH Platform to provide the contracted services to each customer. We use AI to organise the provided data into the format required for effective and efficient implementation. This process also includes verifying and validating the information to reduce errors and improve the quality of the implementation process. This means that we implement the EH Platform for your business at a fast pace and at a lower cost to you. |

Swag Jobs is a job board in which candidates can create a profile and seek jobs. AI-powered features within Swag Jobs include SmartMatch, profile summaries, CV parsing, and AI Wand Enhancements. You can learn more about these features, and the related data handling practices here. |
Legal notice on the inputs and outputs of AI Services
AI Services like Hero AI and AI Wand Enhancements are powered by large language models, and the outputs you receive from these services depend a lot on your own inputs. You are responsible for the data you input into these AI Services with ‘free text’ functionalities. You are also responsible for the outputs of these AI Services, and you should review these outputs to ensure that they are appropriate for your needs.
Your data
Any personal data you provide is processed in accordance with our Privacy Policy, and we only process the personal data you provide to us.
If you input personal data into AI Services like Hero AI or AI Wand Enhancements, you do so voluntarily, and any processing of personal data in these instances are carried out with your consent. Any personal data processed when we perform our AI-Powered Implementations is dependent on the data files you give us, and we provide these services under our contract with you. The ‘Details’ section in the table above also provides information about the data processing activities of each service.
We analyse the performance of our AI Services, and user activity to improve and develop our AI Services. We do not use personal data to train any AI models or for machine learning.
The personal data processed by the AI Services are stored securely on our servers, with appropriate security measures in place to protect against data breaches and unauthorised access. We take steps to ensure that our AI technology partners who support the provision of the AI Services do not store personal data. We also do not permit our AI technology partners to use the personal data of our customers to train their AI models.
We do not sell any of your personal data to third parties.
AI technology partners
We use third parties to provide some of our AI Services. By actively using AI Services like Hero AI and AI Wand Enhancements, you consent to the data you input being transferred to our AI technology partners. We use OpenAI to provide Hero AI and AI Wand Enhancements.
Our AI-Powered Implementations will involve the use of OpenAI as an AI technology partner. We direct the processing of personal data through our AI technology partner to meet our contractual obligations to provide the Implementations services to you as a business customer.
We may also share your personal data with select third party service providers we engage to generally provide the services you request. You can view a full list of our third-party sub-processors here.
Updates to this Statement
We may update this Statement from time to time, and you are encouraged to periodically review this Statement for changes. We may also notify you via email or in-platform notifications if there are significant changes to how we provide our AI Services or if we make material changes to this Statement that affect you.
