About the new Platforms Terms, Service Terms, DPA and Privacy Policy
Summary
As part of Humi by Employment Hero further transitioning into becoming an integrated member of the global Employment Hero family, we’re adopting a new set of Terms and Conditions and policies. These terms and policies are part of a global framework used across the Employment Hero group.
These terms are a more comprehensive and globally consistent set of terms. The new set of terms comes with a fresh look, simplified language, and brings everything into one place. It’s designed to be easier to understand, more transparent, and more aligned with how our platform supports customers today and in the future. But here’s what matters: your key rights, responsibilities, and protections remain the same, and in many cases, they’ve been made clearer and stronger.
- More clarity: The new terms are written in plain language, with clear headings and explanations, minimal legal jargon.
- More protection. We’ve made your rights around data, disputes, and legal protections more explicit and balanced.
- More consistency: These terms apply across Employment Hero’s suite of tools, which means less fragmentation and more reliability as we expand what’s available to you.
- More transparency: We link to detailed privacy and product policies so you know exactly what’s happening with your data and your usage.

Old Humi by Employment Hero Terms vs New Employment Hero Platform Terms
Acceptable Use and Platform Rules
Before: Our acceptable use terms were a bit trickier to navigate and written in legalese.
Now: Our rules set out under clause 12 of the new terms clearly lay out what you can and can’t do, in plain language. We also explain what account admins of organizations are responsible for.
What this means for you: It’s easier to ensure your team is compliant and secure. You’ll spend less time deciphering legal text and more time focusing on what matters.
Stronger and More Explicit Data Rights
Before: You owned your data, but that wasn’t always stated clearly. We followed privacy laws and did backups, but the details were scattered.
Now: We explicitly state that you own your data. We use it to deliver the services and carry out reasonable business activities. The terms also direct you to relevant pages that provide detailed information about our privacy practices such as our Privacy Policy and Data Processing Addendum.
What this means for you: You get the same level of control, now backed by clear contractual language and international-grade privacy commitments.
Better Legal Protection for You
Before: You indemnified us if your use caused legal issues. We only offered limited indemnity in return.
Now: You still indemnify us if your actions cause problems, but we now indemnify you if someone claims our platform violates their intellectual property rights.
What this means for you: If a third party sues you because of something we built, we’ll handle it and cover the costs. That’s a big step forward in your legal protection.
Liability Limits Stay the Same, But Rights Are More Balanced
Before: We capped liability at 12 months of fees subject to carve-outs and exceptions. You couldn’t claim for indirect damages and waived class action rights.
Now: The same cap applies to both parties subject to carve-outs and exceptions, and indirect claims are still excluded, but you no longer waive class action rights. The new provisions are also more balanced and detailed providing clarity around the liability limits that apply to both parties.
What this means for you: Your financial exposure hasn’t changed, but your legal footing has improved. We respect your rights more fully now and provide clearer provisions.
Easier Dispute Resolution, More Legal Options
Before: Any dispute had to go through binding arbitration in Toronto, and you waived your rights to class actions or a jury trial.
Now: We start with negotiation. If that doesn’t work, either of us can go to court. You don’t give up your class action or trial rights.
What this means for you: You now have more control and flexibility in how we resolve disputes. This is a more customer-friendly and transparent process that respects your full range of legal rights.
A Broader and More Holistic Set of Terms
Before: We didn’t offer a permanent free plan. The contract was difficult to read. Specific features had separate appendices.
Now: These terms are easy to understand terms that apply more broadly to the suite of products and services offered by the Employment Hero group, including the classic Humi by Employment Hero platform. There may be references to new features (like Hero Points and AI tools), but to the extent that such features are not available on the Humi by Employment Hero platform, or if introduced, not used by you, then those terms do not apply.
What this means for you: You’re gaining clearer contract experience, with better visibility into how our terms evolve.
