In this blog, we breakdown what exactly the Fair Work Australia information statement is and why it’s changed.
What is The Fair Work Information Statement?
The Fair Work Information Statement (FWIS) is produced by the Fair Work Ombudsman and provides a summary of the rights employees have at work, including those enshrined in the National Employment Standards, State Law and the broader Fair Work Act. The Fair Work Act 2007 requires that every new employee must receive a copy of the Fair Work Info Statement when they start work. The Fair Work Information Statement is an informative guide for employees about their conditions of employment which forms part of the National Employment Standards or NES. This includes summarising rights to paid and unpaid leave, rights to protected action, the rights of the employee when a business changes hands, the rights of the employee when employment ends, as well as where the employee should go for further information and assistance. It also includes information on the National Minimum Wage and the functioning of the Award and Agreement structure. Failure to provide employees with the Fair Work Information Statement can result in penalties of up to $54,000 for a corporation.
What’s Changed with the Fair Work Information Statement?
Whilst the FWIS is usually updated around June each year to reflect changes to minimum wages, this change is a little different. Fair Work Australia has recently updated the Fair Work Information Statement following a Full Federal Court decision handed down on 21 August 2019 which confirmed the correct method for accruing and taking paid personal/carer’s leave under the National Employment Standards. The information in the Fair Work Information Statement has been updated to reflect this decision. An appeal of this decision will be heard by the High Court next year, but in the meantime, the decision made on 21 August 2019 is the current state of the law and applies to affected employers and employees.
